• No watermarks

4.3 Subscription Billing

Premium subscriptions are billed monthly or annually through PayPal. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your PayPal account.

5. User Content and Rights

5.1 Your Photos

By uploading photos to our Service, you represent and warrant that:

• You own the rights to the photos or have permission to use them
• The photos are of yourself and not of other individuals without their consent
• The photos do not violate any third-party rights
• The photos do not contain illegal, harmful, or offensive content

5.2 Generated Photos

6. Prohibited Uses

You agree not to:

• Upload photos containing nudity, violence, or illegal content

• Attempt to reverse engineer or copy our AI models

7. Disclaimers and Limitations

7.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free access. We may suspend or terminate the Service at any time for maintenance or other reasons.

7.2 AI-Generated Content

AI-generated photos may not always be perfect or meet your expectations. We do not guarantee the quality, accuracy, or suitability of generated photos for any particular purpose. Generated photos should be reviewed before use on dating apps or social media.

7.3 No Dating Success Guarantee

While our Service aims to enhance your photos, we make no guarantees about dating success, match rates, or any other outcomes resulting from use of our Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAMEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Any third-party conduct or content on the Service
• Any content obtained from the Service

9. Indemnification

You agree to indemnify and hold harmless FlameAI and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Refund Policy

Due to the nature of our digital service:

• All sales are final once photos are generated
• Subscription fees are non-refundable
• You may cancel your subscription at any time to prevent future charges
• Cancellation does not entitle you to a refund for the current billing period

11. Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, logos, and other content (excluding user-uploaded content) is owned by FlameAI and protected by copyright, trademark, and other intellectual property laws.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
